Article LO6342-4 of the French General Code of Local Authorities

The following are illegal:

1° Deliberations in which one or more members of the territorial council with an interest in the matter that is the subject of the deliberation have taken part, either in their personal name or as agents;

2° Decisions and deliberations by which the local authority waives, either directly or by means of a contractual clause, the right to bring any liability action against any natural or legal person that it remunerates in any form whatsoever.

Sont illégales :

1° Les délibérations auxquelles ont pris part un ou plusieurs membres du conseil territorial intéressés à l’affaire qui en fait l’objet, soit en leur nom personnel, soit comme mandataires ;

2° Les décisions et délibérations par lesquelles la collectivité renonce soit directement, soit par une clause contractuelle, à exercer toute action en responsabilité à l’égard de toute personne physique ou morale qu’elle rémunère sous quelque forme que ce soit.
