Article LO6351-15 of the French General Code of Local Authorities

In the areas of competence of the collectivity, the Territorial Council of Saint-Martin may, by deliberation, request the authorities of the Republic to authorise its President to negotiate, in compliance with France’s international commitments, agreements with one or more States, territories or regional bodies mentioned in Article LO 6351-14.

When such authorisation is granted, the authorities of the Republic shall, at their request, be represented at the negotiations.

At the end of the negotiation, the draft agreement is submitted to the deliberation of the Territorial Council for its opinion. The authorities of the Republic may then, subject to compliance with France’s international commitments, give power to the President of the Territorial Council for the purposes of signing the agreement.

Dans les domaines de compétence de la collectivité, le conseil territorial de Saint-Martin peut, par délibération, demander aux autorités de la République d’autoriser son président à négocier, dans le respect des engagements internationaux de la France, des accords avec un ou plusieurs Etats, territoires ou organismes régionaux mentionnés à l’article LO 6351-14.

Lorsque cette autorisation est accordée, les autorités de la République sont, à leur demande, représentées à la négociation.

A l’issue de la négociation, le projet d’accord est soumis à la délibération du conseil territorial pour avis. Les autorités de la République peuvent ensuite donner, sous réserve du respect des engagements internationaux de la France, pouvoir au président du conseil territorial aux fins de signature de l’accord.
