Article LO6351-21 of the French General Code of Local Authorities

Decisions to waive the obligation to deposit with the State the funds of the local authority or its public establishments, mentioned in Chapter VIII of the single title of Book VI of Part One, fall within the remit of the Territorial Council. However, the latter, within the limits it has set, may delegate to its President the power to take such decisions.

Les décisions de déroger à l’obligation de dépôt auprès de l’Etat des fonds de la collectivité ou de ses établissements publics, mentionnés au chapitre VIII du titre unique du livre VI de la première partie, relèvent de la compétence du conseil territorial. Toutefois, ce dernier, dans les limites qu’il aura fixées, peut déléguer à son président la possibilité de prendre ces décisions.
