Article LO6352-18 of the French General Code of Local Authorities

In compliance with France’s international commitments, the President of the Territorial Council, after having been authorised to do so by deliberation of the Executive Council, negotiates and signs decentralised cooperation agreements with French or foreign territorial authorities, their groupings or public establishments, in matters falling within the authority’s remit. Within this framework, it may join a public body governed by foreign law or participate in the capital of a legal entity governed by foreign law.

Once concluded, these agreements are submitted to the territorial council for approval. They come into force as soon as they have been transmitted to the State representative under the conditions set out in article LO 6341-1.

Dans le respect des engagements internationaux de la France, le président du conseil territorial, après y avoir été autorisé par délibération du conseil exécutif, négocie et signe, dans les matières relevant de la compétence de collectivité, des conventions de coopération décentralisée avec des collectivités territoriales françaises ou étrangères, leurs groupements ou établissements publics. Elle peut, dans ce cadre, adhérer à un organisme public de droit étranger ou participer au capital d’une personne morale de droit étranger.

Ces conventions sont soumises après leur conclusion à l’approbation du conseil territorial. Elles entrent en vigueur dès leur transmission au représentant de l’Etat dans les conditions fixées à l’article LO 6341-1.
