Article LO6352-5 of the French General Code of Local Authorities

The President of the Territorial Council declared to be the de facto accounting officer by a final ruling of the Audit Judge shall be suspended from his capacity as authorising officer until he has received discharge for his management. In this case, the Territorial Council shall deliberate in order to entrust a Vice-President with the powers mentioned in article LO 6352-4. This function ends as soon as the President of the Territorial Council has been discharged from office.

Le président du conseil territorial déclaré comptable de fait par un jugement du juge des comptes statuant définitivement est suspendu de sa qualité d’ordonnateur jusqu’à ce qu’il ait reçu quitus de sa gestion. Dans ce cas, le conseil territorial délibère afin de confier à un vice-président les attributions mentionnées à l’article LO 6352-4. Cette fonction prend fin dès lors que le président du conseil territorial a reçu quitus de sa gestion.
