Article LO6362-9 of the French General Code of Local Authorities

Subject to compliance with articles LO 6362-1, LO 6362-7 and LO 6362-8, amendments may be made to the budget by the territorial council until the end of the financial year to which they apply.

Within a period of twenty-one days following the end of the financial year, the Territorial Council may also make amendments to the budget to adjust the appropriations in the operating section to pay expenditure committed before 31 December and enter the appropriations required to carry out the operations of order in each of the two sections of the budget or between the two sections.

The deliberations relating to the budgetary modifications provided for in the previous paragraph must be sent to the representative of the State no later than five days after the deadline set for their adoption. The payments resulting from the budgetary modifications thus decided must be completed no later than 31 January following the financial year to which they relate.

Sous réserve du respect des articles LO 6362-1, LO 6362-7 et LO 6362-8, des modifications peuvent être apportées au budget par le conseil territorial jusqu’au terme de l’exercice auquel elles s’appliquent.

Dans le délai de vingt et un jours suivant la fin de l’exercice budgétaire, le conseil territorial peut en outre apporter au budget les modifications permettant d’ajuster les crédits de la section de fonctionnement pour régler les dépenses engagées avant le 31 décembre et inscrire les crédits nécessaires à la réalisation des opérations d’ordre de chacune des deux sections du budget ou entre les deux sections.

Les délibérations relatives aux modifications budgétaires prévues à l’alinéa précédent doivent être transmises au représentant de l’Etat au plus tard cinq jours après le délai limite fixé pour leur adoption. Les mandatements découlant des modifications budgétaires ainsi décidées doivent être achevés au plus tard le 31 janvier suivant l’exercice auquel ils se rapportent.
