The State exercises its rights of sovereignty and ownership over its public and private land, sea and air domains. Subject to France’s international commitments and the provisions adopted for their application, the State concedes to the territorial collectivity, under the conditions laid down by a schedule of conditions approved by decree in the Council of State taken after the opinion of the territorial council, the exercise of competences in the area of exploration and exploitation of natural resources, biological and non-biological, of the seabed, its subsoil and superjacent waters.
Subject to the same proviso and under the same conditions, it concedes to the Territorial Council the exercise of powers with regard to the issue and management of mining titles relating to the seabed and its subsoil.
The rules relating to the basis, rate and methods of collection of the specific royalty due by holders of concessions for mines and liquid or gaseous hydrocarbons in the French exclusive economic zone offshore Saint-Pierre-et-Miquelon, established for the benefit of the territorial collectivity, are set by the territorial council.
