Article LO6441-1 of the French General Code of Local Authorities

The territorial council may be seized, by means of a petition, of any matter falling within the competence of the collectivity.

The petition may be presented on an individual or collective basis. It must be drawn up in writing, in any form whatsoever, drafted in the same terms and signed by at least 5% of the electors entered on the electoral rolls in Saint-Pierre-et-Miquelon. It must be dated and include the surname, first name and address of each petitioner and the number of their entry on the electoral roll.

The petition is addressed to the President of the Territorial Council. The Executive Council shall rule on the admissibility of the petition in a reasoned decision, which may be appealed to the Administrative Court.

Where the petition is admissible, the President of the Territorial Council shall report on it to the next session.

Le conseil territorial peut être saisi, par voie de pétition, de toute question relevant de la compétence de la collectivité.

La pétition peut être présentée à titre individuel ou collectif. Elle doit être établie par écrit, sous quelque forme que ce soit, rédigée dans les mêmes termes et signée par 5 % au moins des électeurs inscrits sur les listes électorales à Saint-Pierre-et-Miquelon. Elle doit être datée et comporter le nom, le prénom, l’adresse de chaque pétitionnaire et le numéro de son inscription sur la liste électorale.

La pétition est adressée au président du conseil territorial. Le conseil exécutif se prononce sur la recevabilité de la pétition par une décision motivée, qui peut faire l’objet d’un recours devant le tribunal administratif.

Lorsque la pétition est recevable, le président du conseil territorial en fait rapport à la plus prochaine session.
