Article LO6461-9 of the French General Code of Local Authorities

The deliberations taken in application of the empowerment are adopted by an absolute majority of the members of the territorial council. They may not be submitted to a local referendum.

These deliberations specify the legislative or regulatory provisions from which they derogate.

Appeals against these deliberations are brought before the Conseil d’Etat. The State representative may refer them to the Conseil d’Etat under the conditions and with the effects provided for in article LO 6461-7.

Les délibérations prises en application de l’habilitation sont adoptées à la majorité absolue des membres du conseil territorial. Elles ne peuvent être soumises au référendum local.

Ces délibérations précisent les dispositions législatives ou réglementaires auxquelles elles dérogent.

Les recours dirigés contre ces délibérations sont portés devant le Conseil d’Etat. Le représentant de l’Etat peut les déférer au Conseil d’Etat dans les conditions et avec les effets prévus à l’article LO 6461-7.
