Article LO6462-8 of the French General Code of Local Authorities

The President of the Territorial Council is solely responsible for administration. He may delegate by decree, under his supervision and responsibility, the exercise of part of his functions to the vice-presidents. He may also delegate part of his duties, under the same conditions, to members of the Territorial Council in the absence or impediment of the vice-presidents or when they all hold a delegation. These delegations remain in force until they are withdrawn.

A member of the Territorial Council who has resigned from the office of President of the Territorial Council pursuant to Articles LO 141 of the Electoral Code, L. 2122-4 or L. 4133-3 of this code may not receive a delegation until the end of their term of office as a territorial councillor or until the end of the term of office or function that placed them in a situation of incompatibility.

Unless otherwise provided for in the deliberation delegating powers, the President of the Territorial Council may sub-delegate, under the conditions provided for in the first paragraph, the powers entrusted to him by the Territorial Council pursuant to the provisions of this chapter.

Le président du conseil territorial est seul chargé de l’administration. Il peut déléguer par arrêté, sous sa surveillance et sa responsabilité, l’exercice d’une partie de ses fonctions aux vice-présidents. Il peut également déléguer une partie de ses fonctions, dans les mêmes conditions, à des membres du conseil territorial en l’absence ou en cas d’empêchement des vice-présidents ou dès lors que ceux-ci sont tous titulaires d’une délégation. Ces délégations subsistent tant qu’elles ne sont pas rapportées.

Le membre du conseil territorial ayant démissionné de la fonction de président de conseil territorial en application des articles LO 141 du code électoral, L. 2122-4 ou L. 4133-3 du présent code ne peut recevoir de délégation jusqu’au terme de son mandat de conseiller territorial ou jusqu’à la cessation du mandat ou de la fonction l’ayant placé en situation d’incompatibilité.

Sauf disposition contraire dans la délibération portant délégation, le président du conseil territorial peut subdéléguer, dans les conditions prévues par le premier alinéa, les attributions qui lui sont confiées par le conseil territorial en application des dispositions du présent chapitre.
