Article LO6471-21 of the French General Code of Local Authorities

The territorial council must rule on the public utility nature of the expenditure that has given rise to a declaration of de facto management by the territorial audit chamber during the closest meeting following the transmission of the request sent by the territorial audit chamber to the de facto accounting officer and to the authorising officer of the local authority. Once this deadline has passed, the territorial audit chamber will rule on the expenses relating to the de facto management of which it will assess the justifications presented.

Le conseil territorial doit se prononcer sur le caractère d’utilité publique des dépenses ayant donné lieu à une déclaration en gestion de fait par la chambre territoriale des comptes au cours de la plus proche séance suivant la transmission de la demande adressée par la chambre territoriale des comptes au comptable de fait et à l’ordonnateur de la collectivité. Passé ce délai, la chambre territoriale des comptes statue sur les dépenses de la gestion de fait dont elle apprécie les justifications présentées.
