Article LO7311-8 of the French General Code of Local Authorities

Deliberations taken in application of the authorisation are adopted by an absolute majority of the members making up the assembly. They shall specify the legislative or regulatory provisions from which they derogate.

The deliberations provided for in the first paragraph shall be transmitted to the Prime Minister and to the representative of the State in the collectivity.

They shall be published in the Journal Officiel in the month following their transmission to the Prime Minister. They come into force the day after their publication.

Appeals against these deliberations are brought before the Conseil d’Etat. The representative of the State in the local authority may refer them to the Conseil d’Etat under the conditions and with the effects provided for in Article LO 7311-5.

Les délibérations prises en application de l’habilitation sont adoptées à la majorité absolue des membres composant l’assemblée. Elles précisent les dispositions législatives ou réglementaires auxquelles elles dérogent.

Les délibérations prévues au premier alinéa sont transmises au Premier ministre ainsi qu’au représentant de l’Etat dans la collectivité.

Elles sont publiées au Journal officiel dans le mois suivant leur transmission au Premier ministre. Elles entrent en vigueur le lendemain de leur publication.

Les recours dirigés contre ces délibérations sont portés devant le Conseil d’Etat. Le représentant de l’Etat dans la collectivité peut les déférer au Conseil d’Etat dans les conditions et avec les effets prévus à l’article LO 7311-5.
