Article R.4122-4-10 of the French Public Health Code

The duration of the contract is defined taking into account the nature of the services and the need for periodic competitive tendering.

A contract may provide for one or more renewals provided that its characteristics remain unchanged and that the competitive tendering has been carried out taking into account its total duration.

Unless otherwise stipulated, the renewal provided for in the contract is tacit and the contractor may not oppose it.

La durée du marché est définie en tenant compte de la nature des prestations et de la nécessité d’une remise en concurrence périodique.

Un marché peut prévoir une ou plusieurs reconductions à condition que ses caractéristiques restent inchangées et que la mise en concurrence ait été réalisée en prenant en compte sa durée totale.

Sauf stipulation contraire, la reconduction prévue dans le marché est tacite et le titulaire ne peut s’y opposer.
