Article R.4122-4-11 of the French Public Health Code

I.-The prices of the services covered by a contract are:

1° Either unit prices applied to the quantities actually delivered or performed;

2° Or lump-sum prices applied to all or part of the contract, whatever the quantities delivered or performed.

II.-The National Councils may also conclude contracts at a provisional price. In this case, the clauses of the contracts specify:

1° The conditions under which the definitive price will be determined, within the limit of a ceiling that may be revised;

2° The deadline by which the definitive price must be set;

3° The documentary and on-site checks that the National Council reserves the right to carry out on the technical and accounting elements of the cost price.

I.-Les prix des prestations faisant l’objet d’un marché sont :


1° Soit des prix unitaires appliqués aux quantités réellement livrées ou exécutées ;


2° Soit des prix forfaitaires appliqués à tout ou partie du marché, quelles que soient les quantités livrées ou exécutées.


II.-Les conseils nationaux peuvent également conclure des marchés à prix provisoire. Dans ce cas, les clauses des marchés précisent :


1° Les conditions dans lesquelles sera déterminé le prix définitif, dans la limite d’un plafond éventuellement révisé ;


2° L’échéance à laquelle le prix définitif devra être fixé ;


3° Les vérifications sur pièces et sur place que le conseil national se réserve d’effectuer sur les éléments techniques et comptables du coût de revient.
