Article R.4122-4-24 of the French Public Health Code

If the National Council uses the tender procedure, it cannot negotiate with the tenderers. It may only ask them to specify the content of their tender.

Where the national council uses the procedure with negotiation, it may award the contract on the basis of the initial tenders without negotiation, provided that it has indicated in the contract notice that it reserves the right to do so.

Dans le cas où le conseil national a recours à la procédure d’appel d’offres, il ne peut négocier avec les soumissionnaires. Il lui est seulement possible de leur demander de préciser la teneur de leur offre.

Lorsque le conseil national a recours à la procédure avec négociation, il peut attribuer le marché sur la base des offres initiales sans négociation, à condition d’avoir indiqué dans l’avis de marché qu’il se réserve la possibilité de le faire.
