The National Council verifies the information contained in the application, including that concerning the economic operators on whose capabilities the candidate relies.

If the National Council finds that documents or information required to be submitted as part of the application are missing or incomplete, it may ask all the candidates concerned to complete their application file within an appropriate time limit that is the same for all.

Verification of the suitability to carry out the professional activity, of the economic and financial standing and of the technical and professional capabilities of the candidates may be carried out at any time during the procedure and at the latest before the award of the contract.

When the national council limits the number of candidates admitted to continue the procedure, the verifications mentioned in this article shall be carried out at the latest before the invitation to tender or to participate in the dialogue is sent.

The national council may require only the candidate to whom it is intended to award the contract to provide evidence that he does not fall within a ground for exclusion from the procedure for awarding the contract. It may ask the candidate to supplement or explain the supporting documents and evidence provided.

Le conseil national vérifie les informations qui figurent dans la candidature, y compris en ce qui concerne les opérateurs économiques sur les capacités desquels le candidat s’appuie.

Le conseil national qui constate que des pièces ou informations dont la présentation était réclamée au titre de la candidature sont absentes ou incomplètes peut demander à tous les candidats concernés de compléter leur dossier de candidature dans un délai approprié et identique pour tous.

La vérification de l’aptitude à exercer l’activité professionnelle, de la capacité économique et financière et des capacités techniques et professionnelles des candidats peut être effectuée à tout moment de la procédure et au plus tard avant l’attribution du marché.

Lorsque le conseil national limite le nombre de candidats admis à poursuivre la procédure, les vérifications mentionnées au présent article interviennent au plus tard avant l’envoi de l’invitation à soumissionner ou à participer au dialogue.

Le conseil national ne peut exiger que du seul candidat auquel il est envisagé d’attribuer le marché qu’il justifie ne pas relever d’un motif d’exclusion de la procédure de passation du marché. Il peut demander au candidat de compléter ou d’expliquer les documents justificatifs et moyens de preuve fournis obtenus.
