The National Council rejects irregular, unacceptable, inappropriate or abnormally low tenders under the conditions set out in Articles L. 2152-1 to L. 2152-6 and R. 2152-1 to R. 2152-5 of the French Public Procurement Code.
If a candidate or tenderer is in a situation of exclusion, does not meet the conditions for participation set by the National Council, produces false information or documents in support of his application, or is unable to produce the supporting documents, evidence, additions or explanations required by the National Council within the allotted time, his application is declared inadmissible and he is eliminated.
In this case, when the applications are checked after the candidates have been selected or the tenders have been ranked, the candidate or tenderer whose application or tender was ranked immediately after his own is asked to produce the necessary documents. If necessary, this procedure may be repeated as long as there are still admissible applications or tenders that have not been rejected as inappropriate, irregular or unacceptable.
