Article R.4122-4-27 of the French Public Health Code

I.- Regular, acceptable and appropriate tenders, which have not been rejected pursuant to article R. 4122-4-26, are ranked in descending order by applying the award criteria.

II – The contract is awarded to the tenderer, or where applicable, to the tenderers who have submitted the most economically advantageous tender on the basis of one or more objective, precise criteria linked to the subject of the contract or its performance conditions, in accordance with the conditions set out in article R. 2152-7 of the French Public Procurement Code.

The award criteria and the procedures for their implementation are indicated in the consultation documents. For contracts awarded in accordance with a formalised procedure, the award criteria are weighted or, where weighting is not possible for objective reasons, are indicated in descending order of importance. The weighting may be expressed as a range with an appropriate maximum deviation.

The National Council and the successful tenderer may finalise the components of the contract before it is signed. However, such fine-tuning may not have the effect of modifying the substantial characteristics of the tender or the contract.

Article R.4122-4-27

I.-Les offres régulières, acceptables et appropriées, et qui n’ont pas été rejetées en application de l’article R. 4122-4-26, sont classées par ordre décroissant en appliquant les critères d’attribution.

II.-Le marché est attribué au soumissionnaire, ou le cas échéant, aux soumissionnaires qui ont présenté l’offre économiquement la plus avantageuse sur la base d’un ou plusieurs critères objectifs, précis et liés à l’objet du marché ou à ses conditions d’exécution, dans les conditions prévues à l’article R. 2152-7 du code de la commande publique.

Les critères d’attribution ainsi que les modalités de leur mise en œuvre sont indiqués dans les documents de la consultation. Pour les marchés passés selon une procédure formalisée, les critères d’attribution font l’objet d’une pondération ou, lorsque la pondération n’est pas possible pour des raisons objectives, sont indiqués par ordre décroissant d’importance. La pondération peut être exprimée sous forme d’une fourchette avec un écart maximum approprié.

Le conseil national et le soumissionnaire retenu peuvent procéder à une mise au point des composantes du marché avant sa signature. Cependant, cette mise au point ne peut avoir pour effet de modifier des caractéristiques substantielles de l’offre ou du marché.
