I.- Regular, acceptable and appropriate tenders, which have not been rejected pursuant to article R. 4122-4-26, are ranked in descending order by applying the award criteria.
II – The contract is awarded to the tenderer, or where applicable, to the tenderers who have submitted the most economically advantageous tender on the basis of one or more objective, precise criteria linked to the subject of the contract or its performance conditions, in accordance with the conditions set out in article R. 2152-7 of the French Public Procurement Code.
The award criteria and the procedures for their implementation are indicated in the consultation documents. For contracts awarded in accordance with a formalised procedure, the award criteria are weighted or, where weighting is not possible for objective reasons, are indicated in descending order of importance. The weighting may be expressed as a range with an appropriate maximum deviation.
The National Council and the successful tenderer may finalise the components of the contract before it is signed. However, such fine-tuning may not have the effect of modifying the substantial characteristics of the tender or the contract.
