Article R.4122-4-6 of the French Public Health Code

A Contracts Advisory Committee, set up within the National Council, is responsible for issuing an opinion on bids submitted by candidates in accordance with the procedures set out in articles R. 4122-4-15 and R. 4122-4-16.

Three, five or seven of its members are appointed in accordance with the procedures set out in the internal regulations. The competent authority referred to in article R. 4122-4-5 may not be a member.

Tenders and draft contracts submitted to the Advisory Commission for its opinion must be accompanied by a presentation note, sent to the members of the Commission at least five days before the date of the meeting. Reasons must be given for the committee’s opinion.

The rules of procedure set out the procedures and operation of the committee.

Une commission consultative des marchés, constituée auprès du conseil national, est chargée d’émettre un avis sur les offres des candidats passés selon les procédures mentionnées aux articles R. 4122-4-15 et R. 4122-4-16.


Ses membres, au nombre de trois, cinq ou sept, sont désignés selon les modalités fixées par le règlement intérieur. L’autorité compétente mentionnée à l’article R. 4122-4-5 ne peut en être membre.


Les offres et projets de marché soumis à l’avis de la commission consultative des marchés doivent être assortis d’une note de présentation, transmise aux membres de la commission au moins cinq jours avant la date de la réunion. L’avis de la commission est motivé.


Le règlement intérieur fixe les règles relatives aux modalités et au fonctionnement de la commission.
