Article R1110-10 of the French Public Health Code

The Commission may only sit if at least one member from each of the categories mentioned in 1° and 2° of article R. 1110-9 is present, and provided that parity is respected between the members from these two categories.

A member may not sit if he has a direct or indirect family or professional relationship with one of the parties to the proceedings, which prevents him from carrying out his duties.

The commission may call upon any qualified person or outside expert, in particular from the medical control department, to assist it in its work, without this person or expert being able to take part directly in the conciliation.

The secretariat for the meeting is provided by the authority that received the complaint, unless the two authorities concerned agree otherwise.

All persons taking part in the work of the Commission are bound by confidentiality.

La commission ne peut siéger que si au moins un membre de chacune des catégories mentionnées au 1° et au 2° de l’article R. 1110-9 est présent, et à condition que la parité soit respectée entre les membres issus de ces deux catégories.

Un membre ne peut pas siéger lorsqu’il a un lien direct ou indirect, d’ordre notamment familial ou professionnel, faisant obstacle à l’exercice de sa mission, avec l’une des parties à la procédure.

La commission peut faire appel à toute personne qualifiée ou tout expert extérieur, issu notamment du service du contrôle médical, pour éclairer ses travaux, sans que cette personne ou cet expert puisse directement prendre part à la conciliation.

Le secrétariat de la séance est assuré par l’autorité ayant reçu la plainte, sauf si les deux autorités concernées en conviennent différemment.

L’ensemble des personnes participant aux travaux de la commission sont soumises au secret.
