Article R1110-8 of the French Public Health Code

Discriminatory refusal of care, within the meaning of Article L. 1110-3, any practice intended to prevent or dissuade a person from having access to preventive measures or care, by any means whatsoever and in particular by placing obstacles in the way of effective access to a healthcare professional or to benefiting from the normal conditions for financial coverage of healthcare procedures, services and products, on one of the grounds of discrimination mentioned in articles 225-1 and 225-1-1 of the French Penal Code, or on the grounds that this person benefits from the right to complementary health protection provided for inarticle L. 861-1 of the Social Security Code or the right to state medical aid underarticle L. 251-1 of the Social Action and Family Code.

Article R1110-8

Constitue un refus de soins discriminatoire, au sens de l’article L. 1110-3, toute pratique tendant à empêcher ou dissuader une personne d’accéder à des mesures de prévention ou de soins, par quelque procédé que ce soit et notamment par des obstacles mis à l’accès effectif au professionnel de santé ou au bénéfice des conditions normales de prise en charge financière des actes, prestations et produits de santé, pour l’un des motifs de discrimination mentionnés aux articles 225-1 et 225-1-1 du code pénal, ou au motif que cette personne bénéficie du droit à la protection complémentaire en matière de santé prévu à l’article L. 861-1 du code de la sécurité sociale ou du droit à l’aide médicale d’Etat prévu à l’article L. 251-1 du code de l’action sociale et des familles.
