I.-When the minister(s) to whom the request and the opinion of the territorial conference on public action have been referred have given their agreement, the draft agreement provided for in Article L. 1111-8-1 is drawn up by the State representative, who communicates it to the president of the deliberative assembly or executive council of the applicant territorial authority or public establishment for inter-municipal cooperation with its own tax system, within one year of the transmission of its request.
After agreement on its content has been reached between the State representative and the president of the deliberative assembly or executive council of the territorial authority or public establishment for inter-municipal cooperation with its own tax status, the draft agreement is submitted for approval to the delegatee’s deliberative assembly and then forwarded by the State representative in the region to the ministers concerned.
The agreement is signed by the State representative and the president of the deliberative assembly or the executive council of the territorial authority or of the public establishment for inter-municipal cooperation with its own tax status after publication of the decree delegating responsibility, to which the draft agreement is appended. The delegation takes effect on the date of entry into force set by the agreement and may not exceed six years.
The decree delegating competence and the signed agreement are published in the Journal officiel de la République française and in the recueil des actes administratifs of the local authority or public establishment of inter-municipal cooperation with its own tax status concerned.
II.-The agreement determines the competence or competences delegated, sets the duration of the delegation of competence and the procedures for its express renewal, defines the objectives to be achieved and the procedures for State control of the delegating authority and sets monitoring indicators corresponding to the objectives to be achieved.
It also determines the financial framework within which the delegation is exercised, the operating resources and services, if any, made available to the delegating authority.
The agreement provides for the terms and conditions of its early termination by either of the parties.
