The agreement provided for in article L. 1111-8 is drawn up by the presidents of the deliberative assemblies of the local authorities or public establishments of inter-municipal cooperation with their own tax status concerned.
It determines the delegated authority or authorities, sets the duration of the delegation of authority and the procedures for its renewal, defines the objectives to be achieved and the procedures for control by the delegating authority over the delegatee authority. It sets monitoring indicators corresponding to the objectives to be achieved.
It also determines the financial framework within which the delegation is carried out, the operating resources and services that may be made available to the delegating authority and the conditions under which staff from the delegating authority may be made available to the delegating authority or seconded to it.
The agreement shall, where applicable, provide for the terms and conditions of its early termination.
It is approved by concordant deliberations of the deliberative assemblies of the local authorities or public establishments for inter-municipal cooperation with their own tax status that are party to it.
