Article R1111-6 of the French Public Health Code

A minor who wishes to keep secret any preventive action, screening, diagnosis, treatment or intervention to which he or she is subject under the conditions provided for in article L. 1111-5 may object to the doctor or midwife who carried out this preventive action, screening, diagnosis, treatment or intervention communicating to the holder of parental authority any information that has been compiled on this subject.

A minor who wishes to keep secret any preventive action, screening or treatment to which he or she is subject under the conditions provided for in article L. 1111-5-1 may object to the nurse who carried out this preventive action, screening or treatment communicating to the holders of parental authority the information that has been compiled on this subject.

The doctor, midwife or nurse shall record this objection in writing.

Any doctor, midwife or nurse receiving a request from the holder of parental authority for access to the information mentioned in the first two paragraphs above must endeavour to obtain the consent of the minor to the communication of this information to the holder of parental authority. If, despite these efforts, the minor maintains his or her opposition, the aforementioned request may not be met as long as the opposition is maintained.

When, in application of article L. 1111-7 , the minor requests that the holder of parental authority has access to information concerning his/her state of health via a doctor, this information is, at the choice of the holder of parental authority, sent to the doctor he/she has designated or consulted on site in the presence of this doctor.

La personne mineure qui souhaite garder le secret sur une action de prévention, un dépistage, un diagnostic, un traitement ou une intervention dont elle fait l’objet dans les conditions prévues à l’article L. 1111-5 peut s’opposer à ce que le médecin ou la sage-femme qui a pratiqué cette action de prévention, ce dépistage, ce diagnostic, ce traitement ou cette intervention communique au titulaire de l’autorité parentale les informations qui ont été constituées à ce sujet.

La personne mineure qui souhaite garder le secret sur une action de prévention, un dépistage ou un traitement dont elle fait l’objet dans les conditions prévues à l’article L. 1111-5-1 peut s’opposer à ce que l’infirmier qui a pratiqué cette action de prévention, ce dépistage ou ce traitement communique aux titulaires de l’autorité parentale les informations qui ont été constituées à ce sujet.

Le médecin, la sage-femme ou l’infirmier fait mention écrite de cette opposition.

Tout médecin, sage-femme ou infirmier saisi d’une demande présentée par le titulaire de l’autorité parentale pour l’accès aux informations mentionnées aux deux premiers alinéas ci-dessus doit s’efforcer d’obtenir le consentement de la personne mineure à la communication de ces informations au titulaire de l’autorité parentale. Si en dépit de ces efforts le mineur maintient son opposition, la demande précitée ne peut être satisfaite tant que l’opposition est maintenue.

Lorsqu’en application de l’article L. 1111-7 la personne mineure demande que l’accès du titulaire de l’autorité parentale aux informations concernant son état de santé ait lieu par l’intermédiaire d’un médecin, ces informations sont, au choix du titulaire de l’autorité parentale, adressées au médecin qu’il a désigné ou consultées sur place en présence de ce médecin.
