Article R1112-14 of the French Public Health Code

When a doctor or an intern in the establishment notes that the condition of a patient or an injured person requires urgent care involving a discipline or technique not practised in the establishment or requiring resources which the establishment does not have, or when the patient’s admission presents a definite risk to the operation of the hospital service due to lack of space, the Director shall provide first aid and take all necessary measures to ensure that the patient or injured person is directed as soon as possible to an establishment capable of providing the care required.

In particular, if all the establishment’s incubators are occupied, all arrangements are made for the emergency transport of a premature baby to the nearest establishment with incubators.

Lorsqu’un médecin ou un interne de l’établissement constate que l’état d’un malade ou blessé requiert des soins urgents relevant d’une discipline ou d’une technique non pratiquée dans l’établissement ou nécessitant des moyens dont l’établissement ne dispose pas, ou encore lorsque son admission présente, du fait de manque de place, un risque certain pour le fonctionnement du service hospitalier, le directeur provoque les premiers secours et prend toutes les mesures nécessaires pour que le malade ou le blessé soit dirigé au plus tôt vers un établissement susceptible d’assurer les soins requis.

En particulier, si tous les incubateurs de l’établissement sont occupés, toutes dispositions sont prises pour le transport d’urgence d’un prématuré dans l’établissement le plus proche disposant d’incubateurs.
