Article R1112-62 of the French Public Health Code

Subject to the provisions of article L. 1111-5, with the exception of minors and involuntary patients, patients may, at their request, leave the establishment at any time.

If the doctor in charge of the department considers that leaving the establishment prematurely would endanger their health, the patients concerned will not be authorised to leave the establishment until they have completed a certificate stating that they are aware of the dangers that leaving the establishment would present for them.

If the patient refuses to sign this certificate, a record of this refusal is drawn up.

Sous réserve des dispositions de l’article L. 1111-5, à l’exception des mineurs et des personnes hospitalisées d’office, les malades peuvent, sur leur demande, quitter à tout moment l’établissement.

Si le médecin chef de service estime que cette sortie est prématurée et présente un danger pour leur santé, les intéressés ne sont autorisés à quitter l’établissement qu’après avoir rempli une attestation établissant qu’ils ont eu connaissance des dangers que cette sortie présente pour eux.

Lorsque le malade refuse de signer cette attestation, un procès-verbal de ce refus est dressé.
