Article R1112-87 of the French Public Health Code

Members of the Committee, other than the Chairman, who are involved in a complaint or claim may not sit when the Committee is deliberating on the matter in question.

A full member who is unable to attend or who is involved in a complaint or claim is replaced by his alternate.

If the mediator and his alternate are simultaneously concerned by a complaint or claim, their mission is carried out by an agent designated by the legal representative, in the case of the mediator who is not a doctor, and by a practitioner designated by the chairman of the establishment’s medical committee, the medical advisory committee, the medical commission or the medical conference, in the case of the mediator who is a doctor. In the establishments mentioned in VI of article R. 1112-81, the practitioner is appointed by the legal representative of the establishment.

Les membres de la commission, autres que le président, qui sont concernés par une plainte ou une réclamation ne peuvent siéger lorsque la commission délibère sur le dossier en cause.

Un membre titulaire empêché ou concerné par une plainte ou une réclamation est remplacé par son suppléant.

Si le médiateur et son suppléant sont simultanément concernés par une plainte ou une réclamation, leur mission est assurée par un agent désigné par le représentant légal, lorsqu’il s’agit du médiateur non médecin, et par un praticien désigné par le président de la commission médicale d’établissement, du comité consultatif médical, de la commission médicale ou de la conférence médicale, lorsqu’il s’agit du médiateur médecin. Dans les établissements mentionnés au VI de l’article R. 1112-81, le praticien est désigné par le représentant légal de l’établissement.
