The handover to the administration responsible for the estates of other movable property not claimed under the conditions provided for in article L. 1113-7 is recorded in a report drawn up by the establishment holding the property.
To this end, the person designated in article R. 1113-2 sends the departmental or, where applicable, regional director of public finance for the location of the establishment a draft handover report, by registered letter with acknowledgement of receipt. This draft contains a description of the objects. It also includes the indicative value of the items, except where the nature of the items makes such an indication impossible.
The departmental or, where applicable, regional director of public finance has a period of three months from the date of notification of receipt to indicate whether he accepts, in whole or in part, the surrender of the items. If no reply is received within this period, it is deemed to have refused to accept the items.
A note of the surrender, or of the refusal to surrender, is made in the interested party’s administrative file and in the special register by means of a marginal entry.
A notice of surrender is sent to the applicant, to his legal representative in the case of a minor or, in the case of an adult subject to a legal protection measure with representation relating to the person, to the person responsible for the measure, to the applicant’s family or close relations.
