Article R1121-4 of the French Public Health Code

Insurance contracts for the research referred to in 1° and 2° of Article L. 1121-1 guaranteeing, under the conditions provided for in Article L. 1121-10, the pecuniary consequences of the civil liability of the sponsor and that of any intervening party may not derogate from the provisions defined in this section, except in a way that is more favourable to the interests of the victims or their beneficiaries.

Les contrats d’assurance des recherches mentionnées au 1° et au 2° de l’article L. 1121-1 garantissant, dans les conditions prévues à l’article L. 1121-10, les conséquences pécuniaires de la responsabilité civile du promoteur et celle de tout intervenant ne peuvent pas déroger aux dispositions définies à la présente section, sauf dans un sens plus favorable à l’intérêt des victimes ou de leurs ayants droit.
