The Chairman or, in his absence, the Vice-Chairman sets the agenda for Committee meetings.
Committee meetings are not public. They may be held for all or some of the members by telephone or audiovisual conference.
Opinions are issued by a simple majority of the members present, within the meaning of article R. 1123-11, on the basis of a report by a member of each of the colleges mentioned in article R. 1123-4 designated by the Chairman and, where applicable, by an expert called upon to take part in the Committee’s work under the conditions provided for in article R. 1123-13 or by one of the specialists mentioned in article R. 1125-19.
Voting by secret ballot is compulsory at the request of a member, except when members take part in the debates by means of a telephone or audiovisual conference.
In the event of a tied vote, the Chairman of the meeting has the casting vote.
If a member of the Committee takes part in a discussion in breach of the provisions of the last paragraph of article L. 1123-3, the Chairman shall not take that member’s vote into account.
