Article R1123-19 of the French Public Health Code

I.-As an exception to the provisions of Article 3 of Decree No. 2012-1246 of 7 November 2012 on public budgetary and accounting management, the Committees for the Protection of Individuals are subject to the budgetary, financial and accounting regime defined by Titles I and III of this same Decree, with the exception of 1° and 2° of Article 175, Articles 178 to 185, 204 to 208, the last sentence of Article 210 and Articles 215 to 228, subject to Articles R. 1123-19-1 to R. 1123-19-3 below.

II – The members of the Data Protection Committee, meeting under the conditions provided for in Article R. 1123-11, exercise the powers of the deliberative body for the application of the provisions of the aforementioned Decree of 7 November 2012.

III – The committees for the protection of individuals are subject to the provisions of decree no. 55-733 of 26 May 1955 relating to the economic and financial control of the State.

Article R1123-19

I.-Par dérogation aux dispositions de l’article 3 du décret n° 2012-1246 du 7 novembre 2012 relatif à la gestion budgétaire et comptable publique, les comités de protection des personnes sont soumis au régime budgétaire, financier et comptable défini par les titres Ier et III de ce même décret, à l’exception des 1° et 2° de l’article 175, des articles 178 à 185,204 à 208, de la dernière phrase de l’article 210 et des articles 215 à 228, sous réserve des articles R. 1123-19-1 à R. 1123-19-3 ci-après.

II.-Les membres du comité de protection des personnes, réunis dans les conditions prévues à l’article R. 1123-11, exercent les attributions de l’organe délibérant pour l’application des dispositions du décret du 7 novembre 2012 précité.

III.-Les comités de protection des personnes sont soumis aux dispositions du décret n° 55-733 du 26 mai 1955 relatif au contrôle économique et financier de l’Etat.
