The competent authority shall notify the sponsor of the date of receipt of the dossier and the date on which, in the absence of express authorisation, the research is deemed to have been authorised.
If the dossier is not complete, the competent authority will notify the sponsor of a list of the missing documents and set a deadline for submission, after which the sponsor will be deemed to have withdrawn the application.
With the exception of the research mentioned in article R. 1125-7 which requires express authorisation, the time taken to examine the application for authorisation may not exceed sixty days from receipt of the complete dossier. Silence on the part of the competent authority at the end of this period shall constitute authorisation.
The competent authority may, at any time, ask the sponsor for any additional information that it considers necessary to reach a decision on the application or notify the sponsor of its reasoned objections to the implementation of the research and inform the relevant personal data protection committee. The competent authority sets a deadline for the sponsor to send it its amended project or the additional information requested. This deadline does not suspend the deadline set by the competent authority for deciding on the application. A promoter who does not submit the requested information within the time limit is deemed to have withdrawn his application.
If the sponsor is the Minister for Defence, the request for authorisation is sent via the senior defence official to the Minister for Health.
The decision of the competent authority is forwarded by the sponsor to the relevant personal data protection committee for information.
