Withdrawal of the approval of the practitioner referred to in article R. 1131-6 is incurred in the event of a breach of the prescriptions provided for in this chapter or in the event of a breach of the terms of the approval.
The reasoned decision to withdraw approval is taken by the Director General of the Agence de la biomédecine. The practitioner is informed by registered letter with acknowledgement of receipt from the Director General of the opening of a withdrawal procedure. He will be invited to present his oral or written observations prior to this decision and may be assisted by a defender of his choice.
In an emergency, the approval may be suspended for a maximum period of three months by the Director General of the Agence de la biomédecine.
The Director General of the Agence de la biomédecine shall inform the practitioner, the competent regional health agency and the establishment or organisation holding the authorisation referred to in Article R. 1131-13 in which the practitioner practises of the decision to withdraw or suspend the authorisation.
