Article R1131-11 of the French Public Health Code

Withdrawal of the approval of the practitioner referred to in article R. 1131-6 is incurred in the event of a breach of the prescriptions provided for in this chapter or in the event of a breach of the terms of the approval.

The reasoned decision to withdraw approval is taken by the Director General of the Agence de la biomédecine. The practitioner is informed by registered letter with acknowledgement of receipt from the Director General of the opening of a withdrawal procedure. He will be invited to present his oral or written observations prior to this decision and may be assisted by a defender of his choice.

In an emergency, the approval may be suspended for a maximum period of three months by the Director General of the Agence de la biomédecine.

The Director General of the Agence de la biomédecine shall inform the practitioner, the competent regional health agency and the establishment or organisation holding the authorisation referred to in Article R. 1131-13 in which the practitioner practises of the decision to withdraw or suspend the authorisation.

Le retrait de l’agrément du praticien mentionné à l’article R. 1131-6 est encouru en cas de violation des prescriptions prévues au présent chapitre ou en cas de violation des termes de l’agrément.

La décision motivée de retrait est prise par le directeur général de l’Agence de la biomédecine. Le praticien est informé par lettre recommandée avec demande d’avis de réception du directeur général de l’ouverture d’une procédure de retrait. Il est invité à présenter préalablement à cette décision ses observations orales ou écrites et peut se faire assister d’un défenseur de son choix.

En cas d’urgence, l’agrément peut, à titre conservatoire, être suspendu pour une durée maximale de trois mois par le directeur général de l’Agence de la biomédecine.

Le directeur général de l’Agence de la biomédecine informe de la décision de retrait ou de suspension le praticien, l’agence régionale de santé compétente, ainsi que l’établissement ou organisme titulaire de l’autorisation mentionnée à l’article R. 1131-13 au sein duquel exerce le praticien.
