In a patient presenting a symptom of a genetic disease, a genetic characteristics test may only be prescribed as part of an individual medical consultation.
In the case of an asymptomatic person with a family history, a genetic characteristics test may only be prescribed as part of an individual medical consultation. This consultation is carried out by a doctor working as part of a multidisciplinary team combining clinical and genetic skills. This team must draw up a standard protocol for its management and declare itself to the Agence de la biomédecine in accordance with the procedures laid down by decision of the Director General of the Agence de la biomédecine.
Examinations may only be prescribed for minors or adults under guardianship if they or their families can personally benefit from immediate preventive or curative measures.
The doctor consulted issues a certificate stating that he has provided the person concerned with the information defined in article R. 1131-4 and that he has obtained the person’s consent under the conditions set out in the same article. This certificate is given, depending on the case, either to the approved practitioner carrying out the examination mentioned in 1° and 2° of article R. 1131-2, or to the practitioner responsible for carrying out the examination mentioned in 3° of the same article; a copy of this certificate is placed in the medical file of the person concerned.
