Article R1142-25-1 of the French Public Health Code

The duties of full or alternate member or rapporteur of the Commission entitle the holder to travel and subsistence allowances under the conditions laid down in Decree no. 2006-781 of 3 July 2006 setting the conditions and procedures for payment of expenses incurred by civil servants temporarily travelling within the State.

The Chairman and, where applicable, the Vice-Chairman receive a functional allowance that is not subject to civil retirement pension deductions. Allowances are granted to other members or their alternates if their attendance at Commission meetings results in a loss of income.

The amount of the allowances referred to in the previous paragraph is set by order of the ministers responsible for the budget and health.

The rapporteurs appointed in application of article R. 1142-30-2 receive an allowance for the reports they produce, the amount of which is set by order of the ministers responsible for health and the budget.

Article R1142-25-1

Les fonctions de membre titulaire ou suppléant ou de rapporteur de la commission ouvrent droit aux indemnités de déplacement et de séjour dans les conditions prévues par le décret n° 2006-781 du 3 juillet 2006 fixant les conditions et les modalités de règlement des frais occasionnés par les déplacements temporaires des personnels civils de l’Etat.

Il est attribué une indemnité de fonction, non soumise à retenue pour pension civile de retraite, au président et, le cas échéant, au vice-président. Des indemnités sont attribuées aux autres membres ou à leurs suppléants lorsque leur participation aux séances de la commission entraîne pour eux une perte de revenus.

Le montant des indemnités mentionnées à l’alinéa précédent est fixé par arrêté des ministres chargés du budget et de la santé.

Les rapporteurs désignés en application de l’article R. 1142-30-2 perçoivent en rémunération des rapports qu’ils réalisent une indemnité dont le montant est fixé par arrêté des ministres chargés de la santé et du budget.
