Article R1142-30-2 of the French Public Health Code

To examine the application, the Chairman appoints one or more rapporteurs chosen from within or outside the Commission on the basis of their expertise in the fields for which registration is sought. They will examine the application on the basis of the documents provided pursuant to article R. 1142-30-1 and expert reports on personal injury compensation chosen by the applicant from among those he has drawn up in an amicable or legal context and, where applicable, after interviewing him. The candidate must first delete any information identifying the person or persons whose case he has examined.

The reporter(s) will check the candidate’s theoretical knowledge, particularly in the areas of medical liability and compensation for personal injury, as well as the extent of his professional practice. They ensure that he has sufficient knowledge of expert appraisal techniques.

Where appropriate, they obtain the opinion of the president of the competent professional association or the court with which the candidate is registered as a legal expert, as well as any other opinion they consider useful.

Pour instruire le dossier de candidature, le président désigne un ou plusieurs rapporteurs choisis au sein ou à l’extérieur de la commission en fonction des compétences qu’ils détiennent dans les domaines à raison desquels l’inscription est sollicitée. Ils instruisent la demande au vu des documents fournis en application de l’article R. 1142-30-1 et de rapports d’expertise en réparation du dommage corporel que le candidat choisit parmi ceux qu’il a établis dans un cadre amiable ou juridictionnel et, le cas échéant, après s’être entretenus avec lui. Le candidat efface au préalable les mentions permettant d’identifier la ou les personnes dont il a examiné le cas.

Le ou les rapporteurs vérifient les connaissances théoriques, notamment en matière de responsabilité médicale et de réparation du dommage corporel, ainsi que l’étendue de sa pratique professionnelle. Ils s’assurent qu’il possède une connaissance suffisante des techniques de l’expertise.

Ils recueillent, le cas échéant, l’avis du président de l’ordre professionnel compétent ou de la juridiction auprès de laquelle le candidat est inscrit en qualité d’expert judiciaire, ainsi que tout autre avis qui leur paraît utile.
