I.- Candidates who have never carried out expert appraisals or whose expert appraisals submitted when applying for inclusion on the list referred to inarticle L. 1142-11 do not allow them to be considered as having sufficient knowledge of medical liability expert appraisal techniques may be included on a probationary basis for a maximum period of two years.
During this period, the candidate is assigned to a conciliation and compensation commission. He may not be appointed alone to carry out an expert appraisal. He may only work with one or more experts registered on the national list of medical accident experts and appointed by the chairman of the conciliation and compensation commission concerned.
The National Medical Accidents Commission specifies, within the framework of the recommendations mentioned in the second paragraph ofarticle L. 1142-10, the conditions under which the probationary period is organised.
II – At the end of the probationary period, and with a view to registration on the list referred to in article L. 1142-11 for a period of 5 years, the National Commission for Medical Accidents will examine the candidate’s file, particularly with regard to the expert reports produced during this period, in order to assess his or her knowledge and professional practice.
