Article R1142-31-2 of the French Public Health Code

When the Commission receives an application from an expert to renew his registration, in addition to the conditions mentioned in article R. 1142-30-1, the rapporteur(s) appointed shall check that his knowledge in the field(s) of expertise for which he was registered on the list has been updated and, if he has acquired knowledge in the field of personal injury compensation, verified in accordance with the procedures laid down in article R. 1142-30-2. They also assess the conditions under which the expert has carried out the assignments entrusted to him during the period that has elapsed since his previous registration.

They ensure that the candidate has updated his knowledge of medical liability and assess this knowledge. They shall obtain the opinion of the chairmen of the committees referred to in article L. 1142-5 and, where applicable, the opinions referred to in the third paragraph of article R. 1142-30-2.

Applications for renewal of registration on the national list of medical accident experts must be submitted in accordance with article R. 1142-30, at least six months before the expiry date of the current registration.

Lorsque la commission est saisie d’une demande de renouvellement de son inscription par un expert, outre les conditions mentionnées à l’article R. 1142-30-1, le ou les rapporteurs désignés vérifient que ses connaissances dans le ou les domaines de compétence à raison desquels il a été inscrit sur la liste ont été actualisées et, s’il a acquis des connaissances dans le domaine de la réparation du dommage corporel, vérifiées selon les modalités prévues à l’article R. 1142-30-2. Ils évaluent également les conditions dans lesquelles l’expert a réalisé les missions qui lui ont été confiées au cours de la période écoulée depuis sa précédente inscription.

Ils s’assurent que le candidat a actualisé ses connaissances en matière de responsabilité médicale et procèdent à leur évaluation. Ils recueillent l’avis des présidents des commissions mentionnées à l’article L. 1142-5 et, le cas échéant, les avis mentionnés au troisième alinéa de l’article R. 1142-30-2.

La demande de renouvellement de l’inscription sur la liste nationale des experts en accidents médicaux est adressée dans les conditions de l’article R. 1142-30, au moins six mois avant la date d’échéance de l’inscription en cours.
