The application referred to in Article L. 1142-24-10 shall be lodged with the Office against a receipt or sent to the Office by any means capable of proving the date on which it was sent.
It is accompanied by a file containing all the information mentioned in the second paragraph of article L. 1142-7. It also includes medical certificates specifying the extent of the damage suffered or believed to have been suffered by the claimant. In addition, the claimant must attach any other supporting document, in particular to establish the existence of a malformation or behavioural disorder as referred to in article L. 1142-24-10. The person shall inform the College of any legal proceedings relating to the same facts that may be in progress. If legal action is taken, the person shall inform the judge that the matter has been referred to the Office.
The application form and the list of documents required for the file to be admissible are established by order of the Minister for Health. The Office will request any missing documents. When the application is complete, the Office will send the applicant a receipt stating the date of receipt of all the documents.
The period provided for in the fourth paragraph of Article L. 1142-24-12 runs from the date of receipt by the Office of all the documents required by the order mentioned in the previous paragraph.
