Article R1142-63-8 of the French Public Health Code

The Office registers the application and, if necessary, requests any missing documents.

On receipt of the initial application, the Office informs the manufacturer or manufacturers of the medicinal product concerned and the other persons referred to in Article L. 1142-2 to whom the applicant wishes to enforce the procedure, as well as the social security organisation to which the victim is or was affiliated at the time of the damage he suffered.

The Office informs the other persons mentioned in article L. 1142-2 to whom the procedure has been made enforceable under the conditions mentioned in the last sentence of the second paragraph of article L. 1142-24-2.

The parties implicated by the claimant or the operator(s) must inform the Office without delay of the name of the insurer covering their civil liability, at the time of the claim for compensation and at the time the damage occurred.

L’office enregistre la demande et, le cas échéant, demande les pièces manquantes.


Dès réception de la demande initiale, l’office informe le ou les exploitants du médicament concerné et les autres personnes mentionnées à l’article L. 1142-2 à qui le demandeur a souhaité rendre la procédure opposable ainsi que l’organisme de sécurité sociale auquel est ou était affiliée la victime lors du dommage qu’elle a subi.


L’office informe les autres personnes mentionnées à l’article L. 1142-2 auxquelles la procédure est rendue opposable dans les conditions mentionnées à la dernière phrase du deuxième alinéa de l’article L. 1142-24-2.


Les parties mises en cause par le demandeur ou le ou les exploitants indiquent sans délai à l’office le nom de l’assureur qui garantit leur responsabilité civile, au moment de la demande d’indemnisation ainsi qu’à l’époque de réalisation du dommage.
