Article R1173-11 of the French Public Health Code

The holder of the authorisation for a “maison sport-santé” must declare to the authorities mentioned in the first paragraph of article R. 1173-1 any project to modify the elements on the basis of which the authorisation was granted and provide them with any useful information to enable them to assess this project.

Where it considers, within two months of the declaration referred to in the first paragraph, that the modification is of a substantial nature, the investigating department designated pursuant to Article R. 1173-1 informs the applicant of the need to submit a new application for authorisation and examines it in accordance with the conditions laid down in Article R. 1173-2. Implementation of the modifications is suspended until the authorisation decision is made.

If the modification is not substantial, the authorisation decision is updated.

Le titulaire de l’habilitation d’une maison sport-santé déclare aux autorités mentionnées au premier alinéa de l’article R. 1173-1 tout projet de modification des éléments au vu desquels l’habilitation a été accordée et leur fournit toute information utile pour leur permettre d’évaluer ce projet.

Lorsqu’il estime, dans un délai de deux mois à compter de la déclaration mentionnée au premier alinéa, que cette modification présente un caractère substantiel, le service instructeur désigné en application de l’article R. 1173-1 informe le demandeur de la nécessité de déposer une nouvelle demande d’habilitation et l’examine dans les conditions prévues par l’article R. 1173-2. La mise en œuvre des modifications est suspendue jusqu’à la décision d’habilitation.

Lorsque la modification ne présente pas un caractère substantiel, la décision d’habilitation est actualisée.
