When elements of the human body used on French territory are imported from a State in which one or more of the medical biology analyses mentioned in article R. 1211-14 are not performed, they are accompanied by a biological sample enabling these analyses to be performed in France prior to any therapeutic use. The infectious disease(s) likely to be the subject of this procedure are set by an order of the Minister for Health.
Where the result of one or more of these tests indicates a risk of transmission, the use of imported human body parts and products for therapeutic purposes is prohibited.
However, in the cases defined by the order referred to in the first paragraph, the doctor may, in the interests of the recipient, waive this prohibition under the conditions and according to the procedures laid down in article R. 1211-14.
