Article R1211-19-1 of the French Public Health Code

I. – The purpose of traceability of elements and products of the human body is to establish the link between the donor and the recipient, from the time of removal to the time of therapeutic use or destruction, and vice versa.

This traceability is established :

1° By information, the nature and content of which are laid down by order of the Minister for Health;

2° And, as far as tissues and cells are concerned, on the basis of a coding system that preserves the anonymity of the persons in accordance with the procedures set out in articles R. 1245-31 to R. 1245-37.

II. – When tissues or cells are excluded from the application of the single European code in the case mentioned in the first paragraph of article R. 1245-32, traceability of these tissues or cells is established for all stages of removal or collection up to therapeutic use.

I. – La traçabilité des éléments et produits du corps humains a pour objet d’établir le lien entre le donneur et le receveur en partant du prélèvement jusqu’à l’utilisation thérapeutique ou la destruction et inversement.

Cette traçabilité est établie :

1° Par des informations dont la nature et le contenu sont fixés par arrêté du ministre chargé de la santé ;

2° Et, en ce qui concerne les tissus et les cellules, sur la base d’une codification préservant l’anonymat des personnes selon les modalités prévues aux articles R. 1245-31 à R. 1245-37.

II. – Lorsque des tissus ou des cellules sont exclus de l’application du code européen unique dans le cas mentionné au premier alinéa de l’article R. 1245-32, une traçabilité de ces tissus ou cellules est mise en place pour l’ensemble des étapes du prélèvement ou de la collecte jusqu’à l’utilisation thérapeutique.
