In the event of the termination of the local mandate of an elected member of the national council in respect of which he/she sits on that council, the national association of local elected representatives of the college concerned shall inform the council secretariat by registered letter with acknowledgement of receipt of its decision to maintain, with his/her prior agreement, the elected member concerned in office until the next general renewal provided for in the last paragraph of II of Article L. 1212-1 or appoint a new member in accordance with the procedures set out in the second paragraph of this article. In the event of continuation in office, the agreement of the elected member concerned must be in writing and attached to the registered letter sent to the council secretariat.
In the event of the seat of an elected member mentioned in articles R. 1213-2 to R. 1213-5, the national association of local elected representatives representing the college concerned appoints a new member and informs the council secretariat by registered letter with acknowledgement of receipt, which verifies compliance with the conditions set out in the tenth and thirteenth paragraphs of II of Article L. 1212-1.
