Article R122-12 of the French Intellectual Property Code

A professional responsible for payment of the resale right pursuant to Article R. 122-9 is liable to a fine of the third class for:

1° Not paying the resale right to the beneficiary who requests it in accordance with I of Article R. 122-10;

2° Not to notify one of the collective management bodies in accordance with the provisions of the first paragraph of II of Article R. 122-10;

3° Not to communicate to the beneficiary of the resale right the information provided for in I of Article R. 122-11.

Article R122-12

Est puni de l’amende prévue pour les contraventions de la troisième classe le fait, pour un professionnel responsable du paiement du droit de suite en application de l’article R. 122-9 :

1° De ne pas verser le droit de suite au bénéficiaire qui en fait la demande conformément au I de l’article R. 122-10 ;

2° De ne pas aviser l’un des organismes de gestion collective conformément aux dispositions du premier alinéa du II de l’article R. 122-10 ;

3° De ne pas communiquer au bénéficiaire du droit de suite les informations prévues au I de l’article R. 122-11.
