Article R122-5 of the French Intellectual Property Code

The sale price of each work taken into consideration for the collection of droit de suite is, exclusive of tax, the auction price in the case of a sale by public auction and, for other sales, the transfer price received by the seller.

Droit de suite is not payable if the sale price of the work, as defined in the previous paragraph, is less than 750 euros.

Le prix de vente de chaque oeuvre pris en considération pour la perception du droit de suite est, hors taxes, le prix d’adjudication en cas de vente aux enchères publiques et, pour les autres ventes, le prix de cession perçu par le vendeur.

Le droit de suite n’est pas exigible si le prix de vente de l’oeuvre, tel que défini à l’alinéa précédent, est inférieur à 750 euros.
