Article R1221-33 of the French Public Health Code

At the request of the Agence nationale de sécurité du médicament et des produits de santé or the Director General of the regional health agency, or on his own initiative, the regional haemovigilance and transfusion safety coordinator shall obtain from the relevant haemovigilance and transfusion safety correspondent(s) any information that blood or health establishments collect and hold in application of this chapter.

On the basis of this information, the coordinator carries out or arranges for the haemovigilance correspondents to carry out any research useful for haemovigilance and concerning in particular:

1° The identification of any unit of labile blood product prepared from a donation ;

2° The identification of all units administered to a given patient or the search for any adverse reactions linked, or likely to be linked, to the administration of a given unit or type of labile blood product;

3° Epidemiological data concerning the blood donors from whom the units of labile blood products referred to in 1° and 2° are obtained.

While respecting the anonymity of donors and recipients, the regional haemovigilance and transfusion safety coordinator sends the results of the investigations provided for above to the director general of the regional health agency and to the Agence nationale de sécurité du médicament et des produits de santé.

A decision by the Director General of the Agence nationale de sécurité du médicament et des produits de santé, taken after consultation with the Etablissement français du sang and the Armed Forces Blood Transfusion Centre, may lay down the procedures for the exchange of information relating to these investigations, between the establishments and the coordinator on the one hand, and between the coordinator and the Agency on the other.

A la demande de l’Agence nationale de sécurité du médicament et des produits de santé ou du directeur général de l’agence régionale de santé, ou de sa propre initiative, le coordonnateur régional d’hémovigilance et de sécurité transfusionnelle se fait communiquer par le ou les correspondants d’hémovigilance et de sécurité transfusionnelle compétents toute information que les établissements de transfusion sanguine ou de santé recueillent et détiennent en application du présent chapitre.

A partir de ces informations, le coordonnateur procède ou fait procéder par les correspondants d’hémovigilance à toute recherche utile à l’hémovigilance et concernant notamment :

1° L’identification de toute unité de produit sanguin labile préparée à partir d’un don ;

2° L’identification de toutes les unités administrées à un patient déterminé ou la recherche de tous effets indésirables liés, ou susceptibles d’être liés, à l’administration d’une unité ou d’un type de produit sanguin labile déterminé ;

3° Les données épidémiologiques concernant les donneurs de sang dont proviennent les unités de produits sanguins labiles mentionnées au 1° et au 2°.

Dans le respect de l’anonymat des donneurs et des receveurs, le coordonnateur régional d’hémovigilance et de sécurité transfusionnelle transmet les résultats des investigations prévues ci-dessus au directeur général de l’agence régionale de santé et à l’Agence nationale de sécurité du médicament et des produits de santé.

Une décision du directeur général de l’Agence nationale de sécurité du médicament et des produits de santé prise après avis de l’Etablissement français du sang et du centre de transfusion sanguine des armées peut fixer les modalités des échanges d’information, liés à ces investigations, entre, d’une part, les établissements et le coordonnateur et, d’autre part, entre le coordonnateur et l’agence.
