Article R1222-12 of the French Public Health Code

The Etablissement Français du Sang is subject to the provisions of titles I and III of decree no. 2012-1246 of 7 November 2012 on public budgetary and accounting management, with the exception of 1° and 2° of article 175, articles 178 to 185, 204 to 208 and 220 to 228.

As the chief authorising officer for revenue and expenditure, the Chairman of the Board of Directors may appoint secondary authorising officers. The accounting officer is appointed by order of the ministers responsible for the budget and health.

Secondary authorising officers are appointed by the Chairman, with the approval of the principal authorising officer. These officers may also perform the duties of Chief Financial Officer of a blood establishment.

L’Etablissement français du sang est soumis aux dispositions des titres Ier et III du décret n° 2012-1246 du 7 novembre 2012 relatif à la gestion budgétaire et comptable publique à l’exception des 1° et 2° de l’article 175, des articles 178 à 185, 204 à 208 et 220 à 228.

Ordonnateur principal des recettes et des dépenses, le président du conseil d’administration peut désigner des ordonnateurs secondaires. L’agent comptable est nommé par arrêté des ministres chargés du budget et de la santé.

Les agents comptables secondaires sont nommés par le président, après avis conforme de l’agent comptable principal. Ces agents peuvent également exercer les fonctions de chef des services financiers d’un établissement de transfusion sanguine.
