Article R1222-14 of the French Public Health Code

The Etablissement français du sang and its subsidiaries in which the establishment, alone or with the State or other public establishments, holds more than half of the capital or half of the votes in the deliberative bodies are subject to the rules of financial supervision provided by decree no. 53-707 of 9 August 1953 relating to State control of national public companies and certain bodies with an economic or social purpose, as well as the economic and financial control of the State provided for by decree no. 55-733 of 26 May 1955 codifying, in application of law no. 55-360 of 3 April 1955 and amending the texts relating to the economic and financial control of the State. The conditions for the application of State economic and financial control, taking into account the administrative and financial organisation of the institution, and in particular the organisation of its internal control, are set by order of the ministers responsible for the budget and for the economy and finance.

L’Etablissement français du sang et ses filiales dans lesquelles l’établissement, seul ou avec l’Etat ou d’autres établissements publics, détient plus de la moitié du capital ou de la moitié des voix au sein des organes délibérants sont soumis aux règles de tutelle financière prévues par le décret n° 53-707 du 9 août 1953 relatif au contrôle de l’Etat sur les entreprises publiques nationales et certains organismes ayant un objet d’ordre économique ou social, ainsi qu’au contrôle économique et financier de l’Etat prévu par le décret n° 55-733 du 26 mai 1955 portant codification, en application de la loi n° 55-360 du 3 avril 1955 et aménagement des textes relatifs au contrôle économique et financier de l’Etat. Les conditions d’application du contrôle économique et financier de l’Etat tenant compte de l’organisation administrative et financière de l’établissement, et notamment de l’organisation de son contrôle interne, sont fixées par arrêté des ministres chargés du budget et de l’économie et des finances.
