Article R1222-31 of the French Public Health Code

I.-The head of the laboratory for the biological qualification of donations shall ensure compliance with the regulations applicable to analyses relating to the biological qualification of donations and the proper transmission of information and results between his laboratory and those responsible for the activities of blood establishments whose donations the laboratory qualifies. He/she is responsible for the quality of the analyses carried out. It is responsible for the general organisation of the laboratory, for the training and assessment of laboratory staff and for checking that in vitro diagnostic medical devices comply with pre-established standards or specifications.

II – Only persons who satisfy the conditions laid down in Articles L. 6213-1 to L. 6213-6 may perform this function. They must also possess, or acquire within two years of their appointment, specific skills recognised by diplomas or, where applicable, training courses under conditions laid down by order of the Minister for Health and the Minister for Defence.

I.-Le responsable du laboratoire de qualification biologique du don veille au respect de la mise en œuvre de la réglementation applicable aux analyses relatives à la qualification biologique du don ainsi qu’à la bonne transmission des informations et des résultats entre son laboratoire et les responsables des activités des établissements de transfusion sanguine dont le laboratoire qualifie les dons. Il est garant de la qualité des analyses effectuées. Il est chargé de l’organisation générale du laboratoire, de la formation et de l’évaluation du personnel de laboratoire, ainsi que de la vérification de la conformité des dispositifs médicaux de diagnostic in vitro à des normes ou à des spécifications préétablies.

II.-Peuvent seules exercer cette fonction les personnes qui satisfont aux conditions prévues aux articles L. 6213-1 à L. 6213-6. Elle doivent, en outre, posséder ou acquérir dans les deux ans qui suivent leur nomination des compétences particulières reconnues par des diplômes ou, le cas échéant, des formations dans des conditions fixées par arrêté du ministre chargé de la santé et du ministre de la défense.
